21Vianet Software Products and Software-as-a-Service Privacy Statement

This Privacy Statement covers the privacy practices that 21Vianet employs when providing support, consulting, or hosting services (the "Services") to 21Vianet clients through 21Vianet’s Software-as-a-Service solutions ("Software Offerings"). 21Vianet established this Privacy Statement to clarify 21Vianet’s role as a processor where 21Vianet processes services data on behalf of 21Vianet clients through 21Vianet’s Software Offerings.
Services data ("Services Data") is data that 21Vianet is provided access to in connection with the Software Offerings and the related Services, such as data accessed through a Software-as-a-Service environment or data accessed through test, development and production environments. 21Vianet treats Services Data in accordance with the terms and conditions set forth in the 21Vianet agreement for the Software Offerings and related Services with the 21Vianet client.
Services Data Use. Services Data may be accessed and used to fulfill the requirements specified in the 21Vianet customer agreement for Services or Software Offerings. 21Vianet technical staff may require periodic access to Services Data to monitor system performance, test systems and develop and implement upgrades to systems. Any temporary copies of Services Data created as a necessary part of this process are only maintained for time periods relevant to those purposes. 21Vianet may also be required to provide personal information to comply with legally mandated reportings, disclosure or other legal process requirements. 21Vianet reserves a limited right to disclose any personally identifiable information we receive if required by law or valid order of a court or other governmental authority.
If 21Vianet hires subcontractors to assist in providing Services, their access to Services Data will be consistent with the terms of the relevant 21Vianet customer agreement and this 21Vianet Software Products and Software-as-a-Service Privacy Statement.
21Vianet does not use Services Data except as stated above or as provided in the relevant 21Vianet customer agreement. 21Vianet may process Services Data, but does not control an 21Vianet client’s information collection or use practices for Services Data. If an 21Vianet client provides any Services Data to 21Vianet, the client is responsible for providing any notices and/or obtaining any consents necessary for 21Vianet to access and use Services Data as specified in this statement and the 21Vianet customer agreement.
21Vianet's access to Services Data is based on job role/responsibility. Services Data residing in 21Vianet hosted systems is controlled via an access control list (ACL) mechanism, as well as the use of an account management framework. As 21Vianet clients control access to Services Data by its end-users, end-users should direct any requests related to their personal information to 21Vianet clients.
Certain 21Vianet Software Offerings may provide 21Vianet clients the ability to collect personal information, via cookies and other technologies, from their end-users. 21Vianet clients should seek their own legal advice about any laws applicable to their collection of such information, so that 21Vianet clients can be sure that they are complying with those laws, including providing any required notices and obtaining any required consents.
Modifications to Statement. 21Vianet reserves the right to modify or supplement this 21Vianet Software Product and Software-as-a-Service Privacy Statement at any time. The most recent version of the 21Vianet Software Product and Software-as-a-Service Privacy Statement will appear on this website with the relevant modification date.
